Jamaica’s Commonwealth Games 400 metres hurdles champion Kaliese Spencer has been cleared of attempting to avoid submitting a urine sample by an independent anti-doping panel.

Spencer, also part of a silver medal winning 4x400m relay team at the 2009 World Championships in Berlin, was placed on a three month provisional suspension last year after being accused of wrongdoing by the Jamaica Anti-Doping Commission (JADCO).

She was accused of violating Article 2.3 of the JADCO Anti-doping Rules 2015 relating to "evading, refusing or failing to submit to sample collection".

But the panel chaired by Kent Gammon found in her favour, meaning she can now begin competing again immediately. 

“The Independent Anti-Doping Disciplinary Panel is not persuaded to the standard of proof on the evidence presented that the athlete, Ms Spencer, evaded a sample collection pursuant to article 2.3 of the 2015 Anti-Doping Rules,” they said.

They ruled that JADCO could not prove that the 30-year-old had been correctly told that she was required for a test.

She should now participate at the National Senior Championship from June 22 to 25 in Kingston at which the Jamaican team will be selected for August's World Championships in London.

Her lawyer Paul Greene claimed afterwards that the case should never have progressed to court.

"It is absolutely ridiculous they brought the case,” he told the Jamaica Gleaner.

“My client's life was at stake because of what they did.

“I hope they think hard and long about this next time, because this is a pretty high profile loss for them.

“It was a costly one against them as well, which they deserve.”

Green has also represented many other athletes involved in doping cases including long jumper Darya Klishina when she was cleared as the only member of the Russian athletics team at the RIo 2016 Olympic Games.
